1. Acceptance of Terms
By accessing or using pihsalumni.org (“this website”), or by submitting the membership form linked from this website, you agree to be bound by these Terms of Service and by the Privacy Policy. If you do not agree to any part of these Terms, please do not use this website or submit the membership form.
2. About This Website
This website is operated by the Presque Isle High School Alumni Association (“Association”), a nonprofit-alumni organization formed in support of Presque Isle High School in Presque Isle, Maine. The website is provided for informational purposes and to facilitate membership in the Association, alumni networking, and community events. The content on this website is not professional, legal, financial, medical, or other regulated advice.
3. Hosting, Development, and Roles
This website was built, and is maintained and hosted, by Alexander Wasson (“Host/Developer”), an independent web developer and hosting provider based in the State of Maine, using infrastructure that includes Cloudflare for content delivery and security. It is important to distinguish his roles from those of the Association:
- The Association is the operator and publisher. The Association, acting through its board and authorized representatives, controls, approves, and is responsible for the content published on this website, including recommendations, event information, and the collection of information through the membership form. This website’s content is not the responsibility of the Host/Developer.
- The Host/Developer provides technical services only. Hosting, development, and related infrastructure work does not make the Host/Developer the publisher or speaker of this website’s content, does not constitute editorial control, and, to the extent permitted by applicable law (including 47 U.S.C. § 230), the Host/Developer does not assume responsibility for the Association’s content.
- You are contracting with the Association. These Terms are between you and the Association. The Host/Developer is a third party to this agreement, and his obligations with respect to this website are limited to providing the technical hosting and development services described in his agreements with the Association.
4. Use of Website
You agree to use this website only for lawful purposes and not to:
- Use this website for any unlawful or fraudulent purpose
- Attempt to gain unauthorized access to any part of the website, its servers, or any connected systems or networks
- Interfere with or disrupt the proper functioning of the website
- Scrape, crawl, harvest, or otherwise reproduce substantial portions of the website’s content without prior written permission
- Upload, transmit, or distribute malicious code, malware, or any content that could damage the website or its users
- Impersonate any person or entity or misrepresent your affiliation with any person or entity, including submitting membership information that is not your own
5. Membership and the Membership Form
Membership in the Association is initiated through a membership form published using Google Forms and linked from this website. By submitting the membership form, you agree to:
- Provide accurate, current, and complete information about yourself
- Understand that the information you provide will be used by the Association to maintain its alumni database, send communications, and organize events, as described in the Privacy Policy
- Acknowledge that your submission is processed and stored by Google on behalf of the Association, as described in Section 7 below
Membership is voluntary and may be revoked at any time. The Association may decline, suspend, or terminate a membership at any time for any lawful reason, including for conduct inconsistent with these Terms. If a member is a student under the age of consent or under the age of 18, they should review the Children’s Privacy section of the Privacy Policy and ensure they have the consent of a parent or guardian where applicable.
6. AI-Assisted Development and Content
Portions of this website, including some content, code, and design elements, may be created, drafted, reviewed, or enhanced with the assistance of artificial intelligence (AI) tools. You acknowledge and agree that:
- Text and other content on this website may have been generated, summarized, or refined with the help of AI and is provided for informational purposes only
- AI-generated content may contain errors, inaccuracies, or omissions and should not be relied upon as definitive or authoritative
- Neither the Association nor the Host/Developer warrant the completeness, accuracy, or reliability of AI-assisted content
- You are solely responsible for verifying any information before acting on it, including any information about events, scholarships, or alumni programs
- The use of AI in developing this website does not change the ownership of the website’s content, the responsibility of the Association for its content, or your legal rights and obligations under these Terms
7. Third-Party Services
This website relies on the following third-party services, and your interaction with each is governed by that provider’s own terms and privacy policy:
- Cloudflare — used as a reverse proxy for content delivery and security. Your interaction with Cloudflare is governed by Cloudflare’s website terms and privacy policy.
- Google Forms — used to collect membership information. Your submission of information through Google Forms is processed and stored by Google on behalf of the Association and is governed by Google’s privacy policy and Google’s terms of service.
- calendar.aroostook.me — a third-party community calendar linked from this website. Your use of that service is governed by its own terms and policies.
Neither the Association nor the Host/Developer is responsible for the practices, content, or policies of these third-party services, and neither is responsible for any external website linked from this website.
8. Disclaimers of Warranties
To the maximum extent permitted by law, this website and all content, information, and materials available through it are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Neither the Association nor the Host/Developer warrant that this website will be uninterrupted, error-free, or free of viruses or other harmful components.
9. Limitation of Liability
To the maximum extent permitted by law, neither the Association nor the Host/Developer shall be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of this website, its content, or membership in the Association, even if advised of the possibility of such damages. For any claim arising out of or relating to your use of this website, the total aggregate liability of the Association and the Host/Developer shall not exceed one hundred dollars ($100.00), unless applicable law prohibits such a limitation and then only to the minimum extent required by law. This section does not limit liability to the extent, and only to the extent, that applicable law prohibits such limitation or exclusion.
10. Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless the Association and the Host/Developer, and each of their officers, board members, volunteers, agents, and service providers, from and against claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) to the extent they arise out of or relate to: (a) content you submit through the membership form; (b) your breach of these Terms; or (c) your violation of applicable law or the rights of any third party. Your obligations under this section do not apply to the extent a claim is caused by the gross negligence or willful misconduct of the Association or the Host/Developer.
11. Intellectual Property
All content on this website, including text, images, photographs, code, graphics, and design, is owned by the Association, the Host/Developer, or used with permission, and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, display, or create derivative works from any content on this website without prior written permission, except as necessary for your own personal, non-commercial use. The PIHS Alumni Association logo is used by the Association with permission and is not part of any otherwise-permissive license. Third-party software, libraries, fonts, and other components used in this website remain subject to their respective licenses and remain the property of their respective owners.
12. Termination
The Association may suspend or terminate your access to this website, or your membership, in whole or in part, at any time for reasons including but not limited to: breach of these Terms; illegal activity or reasonable suspicion of illegal activity; abuse of the website or its resources; or compliance with law, legal process, or government request. If you wish to end your membership or delete your information, please use the contact information in your membership communications or request deletion as described in the Privacy Policy. You remain responsible for any ongoing obligations under these Terms that by their nature survive termination.
13. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or this website shall be brought exclusively in the state or federal courts located in the State of Maine, and you consent to the personal jurisdiction of those courts.
14. Entire Agreement and Amendments
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Association regarding your use of this website and your membership, and supersede all prior agreements and understandings. These documents may be amended only in the manner described in Section 16, below.
15. Severability and Waiver
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The failure of the Association to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
16. Changes to Terms
The Association reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated revision date, and continued use of the website or your membership after changes are posted constitutes your acceptance of the revised Terms. For significant changes, the Association will also attempt to notify members through the communications described in the Privacy Policy.
